This “Privacy Policy” is a statement of principles and guidelines that describe Our policies and procedures on the collection, use and disclosure of Your personal information, and tells You about Your privacy rights and how the law protects You. 

We use Your Personal data to provide and improve Service, as well as support employment, infrastructure and human resource management. By using the Service, applying for a job, or accepting a job, You agree to the collection and use of information in accordance with this Privacy Policy. 

1. Interpretation

The words with the initial letter capitalized have the meanings set forth below. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

2.1 “Account” means a unique account created for You to access our Service or parts of our Service. 

2.2 “Company” (also referred to as “the Company”, “We”, “Us” or “Our”) refers to Amanah and its subsidiaries.

For the purposes of the CCPA, Personal Data means any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, to You. 

2.6 “Service” refers to the Website. 

2.7 “Service Provider” means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is to be used. 

2.8 “Usage Data” refers to data collected automatically, either generated by the use of the Service, or from the Service infrastructure itself (for example, the duration of a page visit).

3. Collecting and Using Your Personal Data

While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

5.1 We may use Your Personal Data for the following purposes: to provide and maintain the Service, support employment and human resource management, manage Your account, fulfill and administer contracts and agreements, communicate with You, respond to requests, send email marketing, and for data analysis and service improvements. 

5.2 We may disclose Your Personal Information as we believe to be necessary or appropriate:

5.2.6 We may disclose Your personal information for any other purpose with Your informed consent. 

6. Sensitive Information

We ask that You not send us or share any sensitive Personal Information (e.g., government-issued or financial account numbers, racial or ethnic origin, political opinions, religious beliefs, health, genetic, or biometric data, criminal background or trade union membership). If shared, sensitive information will be stored and used according to section 5.

7. Security of Your Personal Data

7.1 Unfortunately, the transmission of information via the Internet or email is not completely secure. Although we strive to always do our best to protect your personal data, we cannot guarantee the security of your information transmitted through the Service, or over email; Any transmission is at your own risk. Once we have received your information, we will take appropriate technical and organizational measures to safeguard your personal data against loss, theft, and unauthorized use, access or modification. 

7.2 We will, from time to time, host links to and from the websites of our affiliates or third parties. If you follow a link to any of these websites, they will have their own privacy policies, so please check these policies before you submit any personal or sensitive information to those websites. We do not accept any responsibility or liability for these policies.  

7.3 In the event that we become aware of a breach of security leading to the destruction, loss, alteration, unauthorized disclosure of, or access to personal data (a “Data Breach”), we will take reasonable steps to contain, investigate, and mitigate the breach as soon as possible. 

As per the Personal Information Protection and Electronic Documents Act (PIPEDA), we will notify affected individuals and relevant privacy regulators without undue delay. Such notification will include a description of the nature of the breach, the personal data involved, the steps taken to address the breach, and guidance on steps individuals can take to protect themselves. We will also maintain internal records of all Data Breaches in accordance with applicable legal and regulatory requirements. 

8. Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. All Personal Data is stored and processed solely in Canada. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations, resolve disputes and enforce our legal agreements and policies. The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of Our Service, or if the Company is legally obligated to retain this data for longer time periods. 

9. Detailed Information on the Processing of Your Personal Data

9.1 This site uses third-party vendors, such as Google, to deliver advertising on the Internet. Many third-party vendors use cookies to record your visit to the Service and may serve you advertisements based on this information. 

9.2 If you do not wish to receive such ads, you have the option to opt-out and prevent the use of Google cookies. To do this, you can visit Google’s official advertising opt-out page. 

10. Your Rights

In certain circumstances, you have rights to the personal data we hold about you. Below we set out an outline of those rights and how to exercise them. Please note that we will require you to verify your identity before responding to any requests. To exercise any of your rights, please email [email protected]. In your request, please make clear what Personal Information you would like to have changed, or whether you would like to erase your Personal Information from our database. Please note that for each of the rights below, we may have valid legal reasons to refuse your request. In such instances, the Company will give you written correspondence regarding the refusal and an explanation. 

10.1 Access: You have the right to know whether we process personal data about you, and if we do, to access data we hold about you and certain information about how we use it and whom we share it with. 

10.2 Correction: You have the right to require us to correct any personal data held about you that is inaccurate and incomplete. 

10.3 Objection to Marketing: At any time, you have the right to object to our processing of Your personal data for marketing purposes, including where we build profiles for such purposes, and we will cease the processing of Your data for that purpose. 

Amanah Statement on Canadian Privacy Laws

This privacy notice section for Canadian residents supplements the information contained in Our Privacy Policy and it applies solely to visitors, users and others who reside in the State of California, including employees and job applicants.  

  1. Personal Information Protection and Electronic Documents Act (PIPEDA): We are committed to complying with the Personal Information Protection and Electronic Documents Act (PIPEDA), Canada’s federal private-sector privacy law, by only collecting, utilizing, and disclosing personal information for purposes a reasonable person would consider appropriate, and only with Your knowledge and consent unless permitted or required by law. You have the right to request access to Your personal information, request corrections to inaccurate or incomplete information, and inquire about privacy practices.  
  2. Protecting Privacy and Consumer Data (PPCDA): We are also committed to complying with the Protecting Privacy and Consumer Data Act (PPCDA) by maintaining privacy management programs, implementing appropriate precautions, and regularly reviewing our data handling practices. Privacy concerns will be responded to promptly, and according to applicable regulatory requirements.  
  3. Freedom of Information and Protection of Privacy Act (FIPPA): The Company is cognizant of the privacy obligations set out by the Freedom of Information and Protection of Privacy Act (FIPPA) for services concerning Ontario provincial public-sector institutions. The company takes all precautions to protect personal information, and support compliance with privacy impact assessments, data governance, and information security requirements, where applicable.  
  4. Municipal Freedom of Information and Protection of Privacy Act (MFIPPA): The Company takes all precautions in accordance with the requirements of the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA) to provide services to Ontario’s municipal public-sector by handling personal information in accordance with applicable legal requirements and contractual obligations.

  1. Lawful Basis for Data Processing: We are committed to processing personal data in a lawful and transparent manner. We will only process personal data when we have a lawful basis for doing so, such as consent from the data subject or when necessary for contract performance. 
  2. Data Subject Rights: We recognize the rights of data subjects under the GDPR, including the right to access, rectify, and erase personal data. We have implemented processes to enable data subjects to exercise their rights and will respond promptly to any requests. 
  3. Data Transfers: We understand the importance of ensuring the security of personal data when it is transferred outside of the European Economic Area (EEA). We have implemented appropriate safeguards to ensure that any transfers of personal data outside of the EEA are carried out in accordance with the GDPR.
